To some extent, this is necessary for the show to even exist. If the Pat's win a single battle, the Lupins are in jail and the show is over. Either that, or the Lupin just break out all the time, which actually make the pats look even less competent. If the Lupins win, they just take the treasure and go away. Hence, for now at least, the Lupins must necessary win.
