I'm not defending TVN's Zyu stance at all but here's the thing. Garo is licensed for official streaming in the US and will be simulcast worldwide each episode. Meaning as soon as the episode would be available to sub anyway, the actual licensed product will also be available. Zyuranger's official release won't actually be out until sometime next year via Shout, the licensed material has yet to be released.

I'm not saying that it's okay for them to keep those torrents up or anything like that, but that's likely the reasoning they're using for not subbing Garo in this situation. Techincally speaking at this point, their Zyuranger subs don't infringe on actual released material, they will in the future, but they don't yet. Garo subs however would for the afformentioned simulcast reason.
