Yeah he has to be. My guess is that he actually was programmed to be evil and Emu reprogramming worked but he's just playing Cronus now. I remembered Cronus said something to Hiiro about changing the consciousness of those who were stuck as data when they brought Saki back. So I really think Kiriya wasn't faking it at the start but now he has to be. if he did this out of his own free will then he wouldn't join their side later on like he does in the movie.
