According to the Japanese wikipedia, he actually rejected returning, which is why they only mention him off screen but he never appears.

What was the ending you saw? The one where Diend shoots Decade and you get a movie trailer afterwards? That ending basically doesn't count and was replaced by a second version of episode 31 to better line up with Movie Wars 2010 (and stop legal complaints about the show having no ending even if the other ending clearly doesn't close up things either).
