Well, Kitaoka tells Asakura in a previous episode that he's not going to get the police involved again, since Asakura will just break out.

But, more than that, I think it's that sportsmanship thing coming back up again. Kitaoka wouldn't have any problem killing Asakura in a Rider Battle, but at this point I don't think he'd take him out when he's defenseless. It's character growth! Goro would be so proud!
