According to the wiki (so take this with a grain of salt), the Kuroyami and the Caliburdriver were only given the title "Jaken" due to Hayato's betrayal.

As for why would the SoL try to use it, remember the Kuroyami's origins are completely benevolent: It's one of the initial Seiken created around two thousand years ago, and wielded by Yuri along with the Saikou to fight evil.

Don't get me wrong, the name and element are still highly suspicious. But from an in-universe perspective, the sword effectively had no tangible negative associations (again, until Hayato's betrayal).

It's the Batman or the KR Shin of swords, sure it looks scary and sound terrifying. But it's on your side, so go out there and have fun kids.
