The contract is a part of the Deadman, but even then, it's more becoming a monster than any actual contract with stipulations and a price. Even the contracts with Giff don't come with any real cost beyond your humanity.

Well, the contract with a Devil isn't like a contract with a monster from Ryuki or an Imagin from Den-O; the Devil is an aspect of the person given external identity and form. Vice's deal to trade memories for power was crafted in the midst of a traumatic event, and represented Ikki's desire to hide away from the tragedy he was witnessing. Daiji and Sakura don't want those things, so their deals are different. As for the how and why of it as a mechanism... TOKU!
